This book deserves the attention of philosophers of religion. Tracy presents a monumental synthesis of philosophy and history within the context of a "revisionist" theological model. Part I attempts adequately to articulate a method of inquiry by outlining the sets of evaluative criteria, the uses of evidence, and the place of the various philosophical and historical methods within this model. Not only must the method be responsive to the historical tradition, but it also must heed the non-Christian scrutiny of what (...) Van A. Harvey calls the "morality of scientific knowledge," which demands a critical posture toward beliefs and tradition. Tracy’s model involves three steps: 1) phenomenology of the "religious dimension" of our "common experience and language," 2) an "historical and hermeneutical investigation" of the Christian tradition, and 3) "transcendental or metaphysical reflection" in order both to determine the "truth-status" of the previous steps and to effect a critical correlation of philosophy and hermeneutics. I argue that humans have moral relationships with dogs and cats that they could adopt, but do not. The obligations of those of us who refrain from incurring particular relationships with dogs and cats are correlative with the power of persons with what Jean Harvey calls “interactive power,” the power to take the initiative in and direct the course of a relationship. I connect Harvey’s points about interactive power to my application of Eva Kittay’s “dependency critique,” to show (...) that those of us who refrain from incurring particular relationships of dependency rely on caregivers in our communities and regions to fulfill the moral and social demands that an abundance of unowned companionable animals makes on the community. FINS:First, let me thank you and the Pellegrino Center for the honor of giving the John Harvey Collins Lecture in such an interactive manner. The forefront of neurological care—and the neuroethical issues and methods focal to such practice—wasn’t what I initially intended to do professionally, but I think that therein is a good lesson for young people’s career aspirations. Simply put, one doesn’t always know where they’ll end up at the beginning of the journey, and as Kierkegaard said, life is lived forward, but is understood backwards (Kierkegaard 1843).In the nineties and the early 2000s, I was trying to help improve the quality of care of people at the end of life, and I wrote a book, entitled The Palliative Ethic of Care: Clinical Wisdom at Life’s End (Fins 2006), in which I addressed notions of phronesis—practical wisdom—in integrating theory and practice toward improving how people die. I became interested in the Quinlan case (Quinlan 1976), and the right to die, and around the same time, I ran into a colleague of mine at Cornell: Dr. Nicholas D. Schiff. Dr. Schiff is a neurologist, who was a protégé of Fred Plum, who was the originator of the concept of the vegetative state with Bryan Jennett, back in 1972. Fred was both of our teachers here at Cornell. Niko (Dr. Schiff) was interested in patients with disorders of consciousness, and was beginning to envision doing work—that ultimately, we did—using deep brain stimulation (DBS) to try to treat patients in the minimally conscious state, a category that was subsequently codified in 2002.I realized that a whole population of people—with these disorders of consciousness—had been somewhat marginalized, and their neglect essentially devolves back to the considerations of the right to die. The right to die was established in the Quinlan case because Judge Hughes—the presiding chief judge of the New Jersey Supreme Court—talked about Ms. Quinlan’s loss of a cognitive, sapient state as being the moral warrant for her right to die, given the fact that it was viewed as a futile situation. I recognized, over the ensuing years—from my background in palliative and end-of-life care—[1] that we had over-generalized notions of futility... (shrink)

In this paper I try to sort out a tangle of issues regarding time, inertia, proper time and the so-called “clock hypothesis” raised by Harvey Brown's discussion of them in his recent book, Physical Relativity. I attempt to clarify the connection between time and inertia, as well as the deficiencies in Newton's “derivation” of Corollary 5, by giving a group theoretic treatment original with J.-P. Provost. This shows how both the Galilei and Lorentz transformations may be derived from the (...) relativity principle on the basis of certain elementary assumptions regarding time. I then reflect on the implications of this derivation for understanding proper time and the clock hypothesis. (shrink)

Leavitt It is always good to try to make peace, to try to resolve differences between whatsomebelieveare conflictingpoints ofview. Nevertheless, sometimes the points ofview which are believed to be opposed to each other really do oppose one another and so the most ingenious attempts at reconciliation turn out to have been ill-conceived. Wim Klever has brought considerable scholarship to bear in his (...) attempt to show that Hume and Spinoza were not so far apart as we thought.2 It was an especially pleasant surprise to see the comparison of their views on personal identity,3 for example. And he has made a convincing case for doubt that Hume's "sharp anti-Spinözistic utterings"4 in Treatise 1.4.5 were really sincere. In my opinion, however, Klever has gone too farin trying to bring together what should have been left asunder. Some ofhis points ofthe purportedly common ground shared by Hume and Spinoza are based on what I believe to be a blatant misreading ofSpinoza. Other points show a failure to appreciate a fundamental disagreement between Hume and Spinoza on central issues in the old Aristotelian tradition. Hume and Spinoza, like other philosophersofthe seventeenth and eighteenth centuries, can be best understood when one is aware ofthe Aristotelian background against which they were writing and with which they expected their readers to be familiar. Hume shows familiarity with Aristotelianism in his discussion of the "antient philosophy" at Treatise 1.4.3 as well as in his various remarks about scholasticism.6Spinoza'srelationshipto ChristianAristotelianism has been discussed by Wolfson6 and by myself,7 among others. And his relationship to Maimonides, who was his link to Jewish Aristotelianism, has been discussed by Harvey.8 1 shall base my claim that Hume and Spinoza were much further apart than Klever makes them out to be upon an attempt to identify some scholastic and Aristotelian issues and doctrines with respect to which Hume and Spinoza took very different stands. The firstthing which I wanttodraw attention toisKlever'sreading ofthe scholia to 2 Ethics 40, which bears on medieval disputes over the nominalistic, conceptualistic and realistic approaches to Aristotle's treatment of the problem of the universels. Since Spinoza allows that universal notions "are notformed by all men in the same way,"9 Klever Volume XVII Number 2 203 FRANK J. LEAVITT makes him out to be holding the same position which Hume expresses when he adopts Berkeley's opinion that "all general ideas are nothing but particular ones, annexed to a certain term" (T 17). And Klever claims "Hume and Spinoza are both thorough nominalists."10 But Klever misses the point that Hume denies that there are, in addition to particular ideas, universal ones, that is, common notions, while Spinoza clearly admits, in the second scholium to 11 Ethics 40, the difference which Hume denies. According to Spinoza we have (1> confused representations of particular things, and (2) remembered ideas which are "similar to those through which we imagine things." These latter are ideas of the sort which Hume recognized. But in addition tothese two, which Spinoza calls "opinion" and "imagination," Spinoza claims that we have (3) "notions common to all men, and adequate ideas ofthe properties ofthings." These are notions of"those things which are common to all, and which are equallyin a part and in the whole [and which] cannotbe conceived exceptadequately"(2Ethics 38). These notions, which parallel Descartes' "clear and distinct ideas" are the general abstract ideas which Hume denies in Treatise 1.1.7. There Hume denies that ideas can be general "in their nature" but allows that they can be general "in their representation." To the extent to which Hume's position can be called "nominalism," the passages to which I have referred show that Spinoza, who basically accepted the Cartesian doctrine ofclear and distinct ideas, was not a nominalist. Aristotle drew a sharp distinction between imagination and thought in De anima 2.3. Descartes preserved the distinction between imagination and intellection at the beginningofthe fourth Meditation, among other places. This long overdue English translation of Karl Löwith's magisterial study is a major event in Nietzsche scholarship in the Anglo-American intellectual world. Its initial publication was extraordinary in itself—a dissident interpretation, written by a Jew, appearing in National Socialist Germany in 1935. Since then, Löwith's book has continued to gain recognition as one of the key texts in the German Nietzsche reception, as well as a remarkable effort to reclaim the philosopher's work from political misappropriation. For Löwith, the centerpiece of (...) Nietzsche's thought is the doctrine of eternal recurrence, a notion which Löwith, unlike Heidegger, deems incompatible with the will to power. His careful examination of Nietzsche's cosmological theory of the infinite repetition of a finite number of states of the world suggests the paradoxical consequences this theory implies for human freedom. How is it possible to will the eternal recurrence of each moment of one's life, if both this decision and the states of affairs governed by it appear to be predestined? Löwith's book, one of the most important, if seldom acknowledged, sources for recent Anglophone Nietzsche studies, remains a central text for all concerned with understanding the philosopher's work. Carl Schmitt was the most famous and controversial defender of political theology in the twentieth century. But in his best-known work, _The Concept of the Political_, issued in 1927, 1932, and 1933, political considerations led him to conceal the dependence of his political theory on his faith in divine revelation. In 1932 Leo Strauss published a critical review of _Concept _that initiated an extremely subtle exchange between Schmitt and Strauss regarding Schmitt’s critique of liberalism. Although Schmitt never answered Strauss publicly, (...) in the third edition of his book he changed a number of passages in response to Strauss’s criticisms. Now, in this elegant translation by J. Harvey Lomax, Heinrich Meier shows us what the remarkable dialogue between Schmitt and Strauss reveals about the development of these two seminal thinkers. Meier contends that their exchange only ostensibly revolves around liberalism. Genetic information is widely thought to pose unique risks of reidentifying individuals. Genetic data reveals a great deal about who we are and, the standard view holds, should consequently be treated differently from other types of data. Contrary to this view, we argue that the dangers of reidentification for genetic and nongenetic data—including health, financial, and consumer information—are more similar than has been recognized. Before different requirements are imposed around sharing genetic information, proponents of the standard view must show that (...) they are in fact necessary. We further argue that the similarities between genetic and nongenetic information have important implications for communicating risks during consent for health care and research. While patients and research participants need to be more aware of pervasive data‐sharing practices, consent forms are the wrong place to provide this education. Instead, health systems should engage with patients throughout patient care to educate them about data‐sharing practices. (shrink)

Some philosophers have thought that life could only be meaningful if there is no God. For Sartre and Nagel, for example, a God of the traditional classical theistic sort would constrain our powers of self-creative autonomy in ways that would severely detract from the meaning of our lives, possibly even evacuate our lives of all meaning. Some philosophers, by contrast, have thought that life could only be meaningful if there is a God. God and the Meanings of Life is interested (...) in exploring the truth in both these schools of thought, seeking to discover what God could and couldn't do to make life meaningful (as well as what he would and wouldn't do). Mawson espouses a version of the 'amalgam' or 'pluralism' thesis about the issue of life's meaning – in essence, that there are a number of different legitimate meanings of 'meaning' (and indeed 'life') in the question of life's meaning. According to Mawson, God, were he to exist, would help make life meaningful in some of these senses and hinder in some others. He argues that whilst there could be meaning in a Godless universe, there could be other sorts of meaning in a Godly one and that these would be deeper. (shrink)

Intentional mental states have causes and effects. Davidson has shown that this fact alone does not entail the existence of psycho‐physical laws, but his anomalism makes the connection between the content and causation of intentional states utterly mysterious. By defining intentional states in terms of their causes and effects, functionalism promises to explain this connection. If intentional states have their causes and effects in virtue of their contents, then there must be intrinsic states (of the people who have them) which (...) are ‘local causal surrogates’ for the propositions believed, desired, or whatever. We can define these intrinsic states in terms of the laws that govern them, but these laws alone are not sufficient to account for intentional content. To do that we need to invoke laws which link these intrinsic states with their contents. Such a ‘wide’ functional account is sketched; it combines a suggestion of Ramsey's about truth conditions with a ‘feedback’ account of the content of desires. (shrink)

It is not intended as some sort of revelation on my part that Greenberg's cultural theory was originally Marxist in its stresses and, indeed in its attitude to what constituted explanation in such matters. I point out the Marxist and historical mode of proceeding as emphatically as I do partly because it may make my own procedure later in this paper seem a little less arbitrary. For I shall fall to arguing in the end with these essay's Marxism and their (...) history, and I want it understood that I think that to do so is to take issue with their strengths and their main drift.But I have to admit there are difficulties here. The essays in question ["Avant-Garde and Kitsch" and "Towards a Newer Lacoön"] are quite brief. They are, I think, extremely well written: it was not for nothing the Partisan Review described Clement Greenberg, when he first contributed to the journal early in 1939, as "a young writer who works in the New York customs house"—fine, redolent avant-garde pedigree, that! The language of these articles is forceful and easy, always straightforward, blessedly free from Marxist conundrums. Yet the price paid for such lucidity, here as so often, is a degree of inexplicitness—certain amount of elegant skirting round the difficult issues, where one might otherwise be obliged to call out the ponderous armory of Marx's concepts and somewhat spoil the low of the prose from one firm statement to another. The Marxism, in other words, is quite largely implicit; it is stated on occasion, with brittle and pugnacious finality, as the essay's frame of reference, but it remains to the reader to determine just how it works in the history and theory presented—what that history and theory depend on, in the way of Marxist assumptions about class and capital or even abase and superstructure. That is what I intend to do in this paper: to interpret and extrapolate from the texts, even at the risk of making their Marxism declare itself more stridently than the "young writer" seems to have wished. And I should admit straight away that there are several point in what follows where I am genuinely uncertain as to whether I am diverging from Greenberg's argument or explaining it more fully. This does not worry me overmuch, as long as we are alerted to the special danger in this case, dealing with such transparent yet guarded prose, and as long as we can agree that the project in general—pressing home a Marxist reading of texts which situate themselves within the Marxist tradition—is a reasonable one.22. This carelessness distinguishes the present paper from two recent studies of Greenberg's early writings, Serge Guilbaut's "The New Adventures of the Avant-Garde in America," October 15 , and Fred Orton and Griselda Pollock's "Avant-Gardes and Partisans Reviewed," Art History 3 I am indebted to both these essays and am sure that their strictures on the superficiality—not to say the opportunism–of Greenberg's Marxism are largely right. But I am nonetheless interested in the challenge offered to most Marxist, and non-Marxist, accounts of modern history by what I take to be a justified though extreme, pessimism as t the nature of established culture since 1870. That pessimism is characteristic, I suppose, of what Marxists call an ultraleftist point of view. I believe, as I say, that a version of some such view is correct and would therefore with to treat Greenberg's theory as if it were a decently elaborated Marxism of an ultraleftist kind, on which issues in certain mistaken views but which need not so issue and which might still provide, cleansed of those errors, a good vantage for a history of our culture.T. Dispositionalist accounts of colour concepts are now largely discarded. But a number of recent and influential objections to this type of theory can be readily answered providing the dispositionalist account contains the key elements it should---which actual versions in the literature do not. I explicate some of the conceptual components needed in such an account once we correctly understand the anthropocentricity of the colour concepts involved. When these components are incorporated into dispositionalism, including one crucial distinction in particular, some powerful (...) seeming objections against this revised dispositionalism fail. In addition, dispositionalism has extra advantages over the far more popular physicalist theories, and I therefore contend that we should explore vigorously this kind of enriched dispositionalist account. How do we think about animals? How do we decide what they deserve and how we ought to treat them? Subhuman takes an interdisciplinary approach to these questions, drawing from research in philosophy, neuroscience, psychology, law, history, sociology, economics, and anthropology. Subhuman argues that our attitudes to nonhuman animals, both positive and negative, largely arise from our need to compare ourselves to them.

Palliative laser therapy for gastrointestinal tumors is now well established. Its use however may be associated with complications not directly attributable to the laser therapy. These complications potentially decrease the quality of life which opposes the aim of treatment.

Hochstrasser investigates the influence exercised by theories of natural law from Grotius to Kant, with a comparative analysis of the important intellectual innovations in ethics and political philosophy of the time. This book assesses the first histories of political thought since ancient times, giving insights into the nature and influence of debate within eighteenth-century natural jurisprudence. Ambitious in range and conceptually sophisticated, Natural Law Theories in the Early Enlightenment will be of great interest to scholars in history, political thought, law and philosophy. It was well regarded by most and was a favourite of the Emperor Augustus: for references see Mynors at Verg. G. 2.96 and my note at Mart. 14.100.2. It appears, however, to have undue prominence in this poem, supposedly about the earthenware drinking vessels which, presumably, were manufactured in the same area. There is also the question of why (...) Martial refers to Verona in such a circumlocutory way. Is he merely following a well established elegiac/epigrammatic convention in associating Verona with Catullus , or does his circumlocution here have any particular point? (shrink)
